What Is a Private Sewer Lateral?
A private sewer lateral is the underground pipe that carries wastewater from your building to the public sewer main under the street. It typically has two sections:
- Upper lateral: Runs from your building’s cleanout to the cleanout near the property line.
- Lower lateral: Runs from the property line cleanout to the public sewer main.
In older East Bay neighborhoods, these laterals are often made of clay or other aging materials that crack, separate at joints, or allow tree roots to intrude over time. Cracked laterals allow groundwater and rainwater to seep into the sewer system during storms. This can overwhelm treatment facilities and send untreated wastewater into San Francisco Bay.
Why the PSL Program Exists
To reduce these overflows, EBMUD and its partner cities adopted a Regional Private Sewer Lateral Ordinance. The program requires property owners to demonstrate that their sewer laterals are leak-free at certain points, such as when a property is sold. Over time, this helps repair aging infrastructure throughout the East Bay.

The regional PSL ordinance applies in:
- Oakland
- Alameda
- Albany
- Emeryville
- Piedmont
- El Cerrito
- Kensington
- Richmond Annex
Berkeley operates its own separate sewer lateral program with similar requirements. If your property is in Berkeley, check with the City of Berkeley to confirm what applies.
When You Need a Compliance Certificate
Under the regional ordinance, you need a Compliance Certificate when any of the following occur:
Buying or selling a property: A certificate is required to close escrow.
Building or remodeling in excess of $100,000: A certificate is required for final permit sign-off.
Changing your water meter size: A certificate is required when increasing or decreasing water service.
You can also choose to obtain a Compliance Certificate voluntarily, even if none of these triggers apply. Many owners do this proactively to avoid surprises when they eventually sell.
How Long Does a Certificate Last?
Compliance Certificates are valid for:
- 7 years if the lateral passes testing as-is or after repairs
- 20 years if the lateral is completely replaced
A full replacement often makes sense for older clay laterals, since it provides the longest-lasting compliance and eliminates future repair concerns.

If you can’t obtain a Compliance Certificate before closing, EBMUD offers a Time Extension Certificate. This allows the sale to proceed and provides 180 days for the lateral work to be completed.
